Agreement to these terms
These terms apply between you and Orbitex, which operates this website from Pakistan. By using the site you accept them; if you do not accept them, do not use the site. There is no account to create and therefore no step at which to click "I agree", so acceptance is by use. These terms may be updated, and the version published here at the time you use the service is the version that applies to that use.
Who may use the service
You may use the service if you are at least 13 years old and legally capable of agreeing to these terms where you live. If you are using it on behalf of an organisation, you confirm that you are authorised to bind it. The service does not verify age or identity, because it collects neither; this states a condition of use rather than describing a check the system performs.
What the service does
The service accepts a link to publicly available media and, where it is able to, provides a file corresponding to that media. It works only with content the source platform already serves publicly. It does not host a library of media, does not index or organise other people's work, does not provide access to private or restricted content, and does not circumvent access controls, authentication, digital rights management or any other technical protection measure. Supported platforms are listed on the downloaders page, and each platform page states whether that downloader is working today or still planned. Nothing on this site is a promise that a particular platform will keep working, because that depends on the platform.
Acceptable use
You agree to use the service only for lawful purposes and only with media you own or have permission to use. You must not use it to infringe copyright or any other right; to obtain content you are not entitled to access; to harass, endanger or expose any person; to redistribute downloaded material without the rights to do so; or to disrupt, overload, probe, scrape or reverse engineer the service or the infrastructure it runs on. Automated or bulk use outside an interface provided for it is not permitted, and neither is anything designed to evade rate limits. Using the service to build a competing extraction service, or to resell access to it, is not permitted.
Your responsibility for what you download
You are responsible for deciding whether you have the right to download and use any given piece of media, and for what you do with it afterwards. Downloading a file transfers no rights in it: the person who made it still owns it. The source platform's own terms continue to apply to you, and nothing here overrides them - a download this tool can technically perform may still breach the platform's terms, and that is a matter between you and the platform. If you are unsure whether a particular use is permitted, the safe answer is not to.
Intellectual property
Media accessed through this service belongs to its respective owners, and passing through this tool changes nothing about that. The names, logos and trademarks of third-party platforms are the property of those companies and appear here for identification only. This service is independent and is not affiliated with, endorsed by or sponsored by any platform it refers to. The site itself - its text, layout, code and design - belongs to the operator, and you may not copy it wholesale, though nothing stops you linking to it.
Availability and changes
The service is provided as it is at any given moment. Features may be added, changed, limited or withdrawn, and support for a given platform may stop working without notice - most often because that platform changed something on its side, which happens regularly and without warning to anyone. No level of availability, no response time and no guarantee that a particular download will succeed is offered. The service is free, and that is part of why it is offered on those terms.
No warranty
The service is provided as it is and as it is available, without warranty of any kind. Nothing here promises that it will be uninterrupted, error-free or secure, that a particular platform will work today, that a download will succeed, that a file will be of any particular quality, or that information published on the site is complete or current. This is a free tool maintained by one person, and it is offered on the understanding that you use it at your own risk. Where the law where you live gives you rights that cannot be excluded by an agreement like this one, those rights are not excluded and this section does not attempt to.
Limitation of liability
To the fullest extent the law allows, the operator is not liable for loss or damage arising from your use of the service or from your inability to use it, including lost data, lost profits, or any indirect or consequential loss. The service is free, no fee is charged and none is taken, so there is no sum paid against which a cap could sensibly be measured. Two things this section does not do, and does not try to do: it does not exclude liability for death or personal injury caused by negligence, or for fraud, neither of which can lawfully be excluded anywhere; and it does not displace the mandatory consumer protections of the country you live in, which apply whatever this page says.
Suspension and termination
Access may be limited or withdrawn where use breaches these terms or threatens the stability of the service. Because there are no accounts, this ordinarily takes the form of rate limiting or blocking rather than closing anything, and it is usually automatic and temporary.
Changes to these terms
These terms may change as the service develops. The current version is the one on this page and its date is shown at the top. Material changes are reflected in that date rather than made silently, and continuing to use the service after a change means the updated terms apply to that use. If a change is one you are not willing to accept, the remedy is to stop using the service, which - with no account and no subscription - takes no more than closing the tab.
Severability and waiver
If any provision of these terms is found to be unenforceable, that provision is limited or removed to the minimum extent necessary and the rest continues to apply. A failure to enforce a provision on one occasion is not a waiver of it on another. These terms, together with the Privacy Policy, the Copyright page, the Copyright Notice and Takedown page and the Disclaimer, are the whole of the agreement between you and the operator about the use of this site.
Governing law
These terms are governed by the laws of Pakistan, which is where the operator is. One qualification applies regardless, and is stated because it is true rather than because it helps: if you use the service as a consumer, the mandatory consumer-protection rules of the country you live in may still apply to you, and may give you the right to bring proceedings locally, whatever this section says. Nothing here imposes arbitration or waives any right to bring a claim as part of a group; no such clause exists in these terms and none should be read into them.
